Marina Mirage and Glass Restaurant sued for $650,000-plus

A woman is suing Marina Mirage and fine dining restaurant on the Gold Coast for damages starting from $653,850 for negligence after she slipped and fell. She claims it gave her a back injury.

 Salvatrice McGinley, 48, has filed a lawsuit in the Southport District Court listing Marina Mirage, Jones Laing Lasalle real estate, Glass Restaurant, its owners Patrick Gennari and Shanan Harmelan, and Glad Retail Cleaning as responsible for her injuries.

Her lawsuit alleges that she slipped and fell on the driveway outside the Marina Mirage post office.

She claims the accident resulted from the 'negligence' of the respective organisations. The one most at fault, according to the lawsuit, is the Marina Mirage but the other parties could also be held to account.

The lawsuit claims a company employed by Glass Restaurant had “caused a spill of a liquid substance”. This spill, it says, was not cleaned up. The company also failed to inform pedestrians that it was there.

It claims she had suffered “severe injury to the discs in her back”. That’s in addition to cuts, abrasions and psychological injuries.

As a consequence of her injuries, the plaintiff has suffered pain, suffering and loss of amenities of life,’’ the lawsuit says.

She also claims she has incurred medical expenses.

Furthermore, it had affected her livelihood.

According to the lawsuit, she ran a clothing business at Marina Mirage at the time of the incident.

As a result of the injuries, she has had to give up work. She is seeking damages for future loss of income.

Marina Mirage and Glad Retail Cleaning did not return calls when contacted by the Gold Coast Bulletin.

Glass Restaurant refused to comment.

Jones Laing Lasalle said it was unaware of the lawsuit.
