Cocaine and boxing no excuse for 'vicious' attack at Gosford pub

A man convicted of an unprovoked attack on a stranger at a Gosford pub has appealed his 18-month sentence on the grounds he has brain “deficits” following a car accident that led to depression.

Dylan Brady pleaded guilty to his attack of a 40-year-old man in the pub's gaming room on February 6.

Brady beat the man unconscious shortly after being approached for a light, leaving the victim slouched against a poker machine.

But his barrister called for leniency in the sentence, arguing his client had been damaged by too much boxing and cocaine exacerbated by a car accident that triggered a “descent into depression”.

The court was told Brady was only appealing “the affray” component of the sentence making him a candidate for an intensive corrections order (ICO) to be served in the community rather than jail.

The Crown prosecutor argued against an ICO, saying the main issue was alcohol.

Judge Alistair Abadee described the attack as “particularly vicious” and dismissed the appeal.
