Restaurant owner fined for liquor act breaches

The owner of a Hamilton restaurant has been ordered to pay six and half thousand dollars in fines and court costs for two breaches of the liquor act.

Novac Pearce the operator of the Kavon Theatre restaurant was originally facing a total of five charges in relation to the promotion and sale of liquor, namely jelly shots and a six shot cocktail called poison punch.

Undercover inspectors from the office of Liquor Gaming and Racing said they observed the offences after going to the restaurant in July 2009.

They issued a penalty notice but claimed the offences were still being committed when they returned a year later.

Officers found the poison punch was not being sold in an appropriate container in line with regulations.

Magistrate Mark Buscombe convicted Ms Pearce of two charges but dismissed the other three saying there was not enough evidence to support them.

Ms Pearce was directed to pay fines of $800 on each of the two charges and $5,000 costs.
