Man sues Star Casino for $300K after “aggressive” eviction

A concreter who broke his thumb when he was thrown out of Star Gold Coast Casino is suing the entertainment giant for $300,000.

Thirty-seven-year-old Jamie Crompton claims security was far too forceful when they threw him out of the venue in February last year for not wearing a mask. 

Crompton filed the claim in Southport District Court this week, alleging security staff used 'grossly excessive' force.

A claim filed by Shine Lawyers states: “The croupier/dealer at the table asked (Mr Crompton) to put his face mask on… [he] initially questioned whether it was still a requirement to wear face masks, and then complied with the request.

“After [Mr Crompton] put his face mask on the croupier/dealer advised (him) that he was 'too intoxicated' and needed to leave the premises.

“[Mr Crompton] calmly advised the croupier that he was not intoxicated and questioned … as to why he needed to leave. The croupier/dealer then called the defendant's security staff for assistance.”

It is claimed the security guards threw Crompton to the ground and forcefully tried to restrain him by putting his wrists behind his back.

Crompton claims he asked security to ease the pressure, mindful of the metal plate in his left hand from an old injury.

However, Crompton was held to the ground for two minutes and 43 seconds before he was shown the door. 

The claim states: “Despite (his) pleas, the security staff did not ease up the force of their restraints, and if anything, the restraints became more forceful.”

Crompton says he was not being aggressive.

“The force applied by the defendant's security staff throughout the incident was grossly excessive and a complete over-reaction in the circumstances,” the claim states.

Crompton says he suffered a thumb fracture, sprained fingers, strained spine and facial abrasions as well as PTSD, anxiety, stress and depression from the incident.

Damages would include past and future income loss, painkillers and hand therapy. 

Star Entertainment has not commented.
